Hi All,
We hvae manufacturing unit in Navi Mumbai, just to know the opinion on my post - If my contractor has applied for a labour license for 100 labours and he have copy of application, and valid license to be granted from the authority, can he start the work with 100 or less than 100 labours since date of application? Is there any rule/provision as per Contract Labour Act?

Thank's for the circular.
Please can you guide me if we do not deduct ESI from an employee working in a factory whose total salary including OT (overtime) is more than 21000/- and some misshaping happens, who is going to pay the medical allowance and damages (in case of death).

follow this ... " Overtime wages could not be treated as "wages" for the purpose of contribution under the Hind Art Press v. ESI Corporation 1990 (1) LLJ 195"

Dear Subvimal,
your attachmed file has wrong calculations,
You have calculated ESI on above 21k, which is wrong,ESI applicable only on Equal to or Below 21000 Gross salary.
Coming to PF, PF should be detected only on Basic+DA, Limit of PF ceiling is 15000 (Basic + DA).
