Gratuity Confusion: Does 5.7 Years of Service Qualify for 5 or 6 Years of Benefits?

Kindly confirm if 5.7 years of continuous service makes a staff member eligible for 5 years of gratuity or 6 years of gratuity.

I joined the company on 31.12.2012, and my last day at this organization was 31.07.2018, totaling my working period to 5 years and 7 months. Therefore, I am unsure if I am eligible for 5 years of gratuity or 6 years of gratuity. The organization informed me that I am eligible for only 5 years, but I have completed 5.7 years, which means I have exceeded six months. Hence, I believe I should be eligible for 6 years of gratuity. Please assist me with this clarification.

Please read the rules regarding service of six months and how it is treated for working out gratuity.

You will get 6 years for calculating gratuity.

Yes, if you have completed 5.7 years of continuous service, then you will be entitled to 6 years of gratuity.

Hi,

Once you become eligible for gratuity, the calculation is quite simple thereafter. Any period of a year (the last in that company) in which you have worked for more than 6 months should be treated as one full year. In your case, it has to be 6 years, no ifs, no buts.

Even, I have the same case in my current organization, but they are ready to pay me for 6 years of service. I have only worked for 5 years and 6 months, but LIC will pay me for 6 years of service. You have to request your concerned person with a soft voice to get this matter resolved.

You are eligible for 6 years for gratuity calculation. If an employee worked for 5 years and 5 months, it will be treated as 5 years. If an employee worked for 5 years and 6 months, it will be taken as 6 years.
