Employee's incomplete notice period - what would be the appropriate action we can take?

If an employee is on his/her probation period and served his/her notice period of 13 days to the management and the rule is to serve the notice period for a Month, so what would be the appropriate action we can take? Please help me out.

The salary for the remaining 17 days of the month could be deducted from the full and final settlement dues of the employee.
