Frustrated with Delayed Salary Release After Resignation: What Steps Can I Take?

I resigned from the company on 03.02.18, and my resignation was accepted. I completed my one-month notice period there. After that, they withheld my 2 months' salary. I sent some emails regarding this and also spoke to them on the phone. As a result, they released one month's salary, but for the remaining amount, they mentioned that it would be released after 45-60 days with the full and final payment.

It has now been four months since I resigned from the company, and my salary has still not been released. Despite sending numerous emails, I have not received any responses. Every time I call, they assure me that my salary will be released the following month, but it has not happened yet.

What should I do in this case?

Escalate the issue to higher-level officials in writing, duly acknowledged.

In case you are earning less than Rs 18,000, you can file a claim with the local Authority under the Payment of Wages Act, 1936. This information can be obtained from the local Labour Office. The fact that your salary has not been released even after 4 months indicates a deliberate violation of the Act.

Since he did not mention in which capacity he was working, I have asked him to clarify so that if entitled, he can go to the Labour Officer of the area.

If your salary is less than $18,000, follow the labor court route. Otherwise, send a legal notice for unpaid salary through a local lawyer.
