Need help regarding Leave issues at workplace

THOMASYESUDAS09
I am working in a textile manufacturing unit in surat, gujarat. Here in total we have 6 days leave in a year (1-Holi, 1- Rakkshabandhan, 4-Holi) for staff. Even staffs are required to come on Sundays and work till 3:00 pm. Duty Hours are from 9:30 am to 7:30 pm with 15 minutes lunch break and 5 minutes tea break. Inspite of all these if we take more than 2 leaves in a month, they will deduct our salary. No overtime for extra working hours and Sunday. Yearly bonus they give as per their wish. No fix increament structure, employees have to meet Directors and bargain for increase in salary. I have tried speaking with directors to atleast follow Government Labour Rules so that everyone can get rest and be more productive at work but they are keeping a deaf ear to this issue. Is there any way to solve this problem?? Please help.

Dear Thomas,
First and foremost, you need to remove your wrong understanding about weekly off, closed holiday and earned leave.
As far as weekly off is concerned, an employee is eligible for the weekly off after rendering six days of work. Closed holiday list has to be declared as per the rules of the state government. Minimum 10 closed holidays need to be declared, which include national holidays also. As far as earned leave is concerned, for every 20 working days, an employee is eligible for a days leave. Roughly this works out to 15 days per anum.
Lastly, about working hours in the company. Workday from 0930 to 1930 hours is unjustifiable.
You say that your pleas about easing working conditions have fallen on deaf years. This is because your state is notorious for the violation of the labour laws. That this exploitation should happen in a company that falls within purview of the state which has given Prime Minister to this country speaks volumes! Quite unfortunate!
Are you from HR? Whether you are from HR or not, you may tell few employees to approach the Labour Officer (LO) of your area. Of course, this kind of exploitation cannot happen without tacit countenance from LO is a different matter. However, somewhere you have to make a beginning.
Thanks,
