Maternity leave - company is saying you should go to ESI maternity policy, company is not liable to pay you

My frnd is working with an organisation from 2.5 years last october se get promotion and her salary is above 21000. and from october month she dnt have any Esi deduction too. But now company is saying you should go to ESI maternity policy, company is not liable to pay you any thing accept ESI.

Yes your company is saying correctly on the basis of following thus please refer the same :
Contribution period
1st April to 30 September
1st October to 31st March of the year following
Corresponding benefit period
1st January to 30th June of the year following
1st July to 31st December of the calendar year

Thanks sir for update but as per new update of maternity policy only person who are below 21000 should go to esi. and above maternity leave are paid by company.

and may be her delivery date will be july or august.than if she is not under esi .
