Employee Back from ESIC Leave but Struggling at Work: What Are My Options?

Can anyone solve my query regarding the employee who has returned from ESIC leave but is unable to work in my company? What should I do in this situation? He is not able to perform the tasks required by my company. I need to address this issue, but what is the next step? Should I terminate his employment because he does not meet the qualifications for this job?

Please get it certified from the ESI doctor that he is unable to work. Until he becomes fit, ask him to go on sick leave again under ESI/LOP, whichever may be the case.

As per the law, if he is not able to perform such a job, the company should assign another job which he can perform. Alternatively, another way is to make some settlement with him for resigning.
