Struggling to Withdraw PF from Exempted Organization: How Can I Navigate This Complex Situation?

Served in an organization for 20+ years and resigned 3 years ago, yet I still have not received my PF money. The employer filed a civil suit for defamation when I tried to bring forward their reluctance to release my money to the senior management. The employer is on the exempted list. Since I resigned in 2014, I didn't have a linked UAN, but I have been allotted one using Aadhaar. I am unable to secure another job due to negative feedback from the previous employer and possibly the court case appearing in background checks, making it difficult to get it transferred.

Doubts

I do have a member ID for the private trust. Is there any way I can link it with the UAN? Also, while trying to enter details as KYC in the UAN portal, it required a document number. Could someone point out what that number is referring to here?

Kindly advise on how I can proceed from here for withdrawal or any other way through which I can get my PF.

Thanks for the reply. I didn't understand what you mean by regional commissioner. If you mean regional PF commissioner, I have tried calling the office using the number provided on the site, but to no avail. Do you have any other suggestions?

Exempted Fund

In a company-run exempt fund, an EPF Private Trust, recognized by the EPFO and which pays at least the same interest as the EPF, has duties and responsibilities similar to the EPFO. EPF Private Trusts are formed by firms that can manage the PF money and accounts of their workers themselves and have an exemption from filing PF returns. The members of these trusts enjoy income tax and other benefits at par with EPFO subscribers. Such establishments that seek exemptions and create EPF Private Trusts are called exempted establishments. However, the pension is payable only by the EPFO.

Your trust cannot delay your dues without risking losing their exempt status if someone pushes the case of delayed payments, etc. Meet the EPF Commissioner of the area under whose jurisdiction the company falls. Three years is a long period.

Dear Harvey, you have not furnished full information regarding your previous employment. Information in bits and pieces will not suffice. Please clarify your statement: "Employer filed a civil suit for defaming me when I tried to bring forward their reluctance in issuing my money to the senior management."

If you have resigned and been relieved from the service, there should not be any problem regarding the withdrawal of your PF either from the PF department or from the Trust. It appears that your previous employer is holding your PF withdrawal from the Trust for reasons best known to you and your employer.

As already suggested by honorable members, please go over to the jurisdictional PF office with all documents without any further delay. Please note that the PF amount is free from all attachments.
