Feeling Stuck: How to Handle a Bank Job Resignation When Your Boss Won't Let You Leave?

Hello Friends, As the name suggests, I am a Relationship Manager working with a private sector bank in Pune. I have received a good offer from another bank and want to accept it. I have discussed it with my manager and submitted my resignation. However, my manager, his supervisor, and even HR are not accepting my resignation. They are, in fact, pressuring me to generate more business before approving my resignation. It seems like they are playing mind games to delay my departure and prevent me from joining my new bank on time.

I have evidence that I have submitted my resignation with a last working day of December 31st. Despite this, all my supervisors, including HR, are not approving it and are forcing me to reject the new offer and continue working with them.

What should I do in this situation?

What are the rules for resignation in your bank?

Have you followed the rules for the submission of resignation? Send a reminder and then escalate the issue so that your resignation gets accepted. They cannot compel you to work for them.

One suggestion: when you pose a query, at least stick to decent grammar and punctuation, etc. Here, a lot of working professionals would be seeing the query, and poor presentation of the query can be off-putting.

Resignation and Forced Employment Under Indian Law

Presuming that you have complied with the rules regarding resignation from service, such as the notice period, by 31st December, you have the right to be relieved from service upon the completion of the notice period. The notice period is provided for the smooth completion of alternate arrangements to be made by the company; it cannot be used as a ruse to impose unreasonable conditions before accepting the resignation. They may be attempting to delay the acceptance and frustrate you, but you can bring to their attention that forced employment is not allowed under Indian conditions.

According to Article 23 of the Constitution of India, all forms of forced labor are prohibited, and any contravention of this provision is an offense punishable in accordance with the law. It can be argued that by refusing to relieve you, the company is engaging in a violation of the Constitution, which is not a trivial offense. Speak up about it in your office.
