Facing a Longer Notice Period: Should I Follow My Original Contract or the New HR Policy?

I have been working with this company for the last 3.5 years. My confirmation letter mentioned that I have to serve a 30-day notice period on either side or pay 30 days' basic salary in lieu. Last week, as per the decision of our management team, the revised HR policy stated that confirmed employees have to serve a 45-day notice period on either side or pay 45 days' basic salary in lieu. This change is not acceptable to me.

At this moment, I am resigning, so I need suggestions on whether I should follow the confirmation letter or the revised HR policy.

Did you consider resigning after the policy change or before? What is the specific issue for you in completing 45 days? Is your current employer requesting you to start earlier?

If you want an exemption, speak to your HR as the policy has recently been modified. Perhaps, they can address it and release you sooner. Avoid putting yourself in a difficult situation, especially since you have been with the company for a significant period. Try to persuade HR for a smooth exit.

If there is a term in any letter issued by the company to you stating that you agree to accept any changes in terms of appointment or rules if they are made, then you are required to serve a 45-day notice period.
