Struggling with Delayed Salaries and Missing PF Deposits: What Legal Steps Can I Take?

Dear Sir, I am currently employed at XXX Clubs Limited, where there have been issues with timely salary payments. Each month, I find myself needing to request (or rather, beg) my employer for my salary, and only after much persuasion is it eventually credited to my account. While the salary eventually comes through, there remains a significant backlog of three to four months. For instance, the most recent salary I received was for June 2017, but it was not paid until September 2017.

Furthermore, it has come to my attention that our employer has failed to deposit our Provident Fund (PF) contributions for the past two and a half years. The last PF deposit made was back in July 2015.

I am seeking your advice on the appropriate legal or diplomatic actions that can be taken in this situation.

There seems to be a serious financial trouble, and I would suggest you search for a new job immediately. Not depositing PF deducted from an employee is a serious offense and has to be addressed legally.

As far as the delay in the issue of salary is concerned, does it take place only for you or does it happen to all employees? To handle the delay in the disbursement of salary, you may submit an application to the Managing Director of the company either individually or jointly. In the application, explain the difficulties you face in managing your household activities without receiving your salary. If the employer remains unresponsive, you may submit an application to the Labour Officer under whose jurisdiction your company falls. The application can be submitted individually or jointly.

If the PF (Provident Fund) amount has been deducted but not deposited, you may file a formal complaint with the PF office. This complaint can be made individually or jointly.

I agree with Mr. Dinesh. It is better to find a new job. Once you have found a job, you can ask your employer to deposit your remaining salary and PPF. Otherwise, you may need to pursue legal action to obtain it.
