Gratuity - 4.6 year in my company - if I resign now will I eligible?

I have completed 4.6 year in my company so if I resign now so will I eligible for Gratuity.

Legally speaking, you become eligible to draw gratuity if you complete 4 years and 240 days. However, keeping law aside, will it matter if you complete five years? As such you have completed four and half years so what is the challenge if you complete six more months?
