Gratuity Eligibility: Can I Get It If I Resign After 4.6 Years at My Company?

I have completed 4.6 years in my company. If I resign now, will I be eligible for Gratuity?

Legally speaking, you become eligible to draw gratuity upon completion of 4 years and 240 days of service. However, setting the law aside, would it make any difference if you completed five years? Considering you have already completed four and a half years, what would be the challenge in completing an additional six months?
