Facing Pressure to Resign After Pregnancy: How Can I Secure My Maternity Leave?

anuradhajoarder_219737
Dear Concern, my name is Anuradha. I am from Bangalore and work as an HR professional in a garment company. I have been with this organization for the last 3.7 years and have consistently received good performance ratings. Everything was going well until I conceived in April 2017 and informed my employer in the same month to ensure a proper handoff before my planned leave.

However, my commitment to work started being questioned by my supervisors, and I began facing various forms of mental harassment. Suddenly, I was labeled as a poor performer. Now, in September 2017, as I am preparing to take maternity leave, my employer has requested me to resign, but I am not willing to do so.

I seek your advice on what steps I should take to avail of my maternity leave and continue my employment in the same organization. Thank you for your help.

Sincerely, Anuradha

In the last 2-3 months, there has been a voluminous discussion on maternity leave. You may check the following links to refer to those threads: https://www.citehr.com/587381-compan...ng-resign.html https://www.citehr.com/588912-matern...asking-me.html https://www.citehr.com/585518-matern...-employee.html https://www.citehr.com/585888-matern...r-joining.html

Go through the above threads, find out what is the most appropriate solution for you, and come back to this forum again. As you are from HR, no detailed explanation is necessary.

Dear Dinesh,

Thank you for your information; it's really helpful. One thing I need to know is that my employer has asked me to resign verbally, with no written communication. Can I send an email to my seniors about this, or should I wait for an email from them?

Thanks in advance.

Please don't resign from your side. The employer can't take any action (termination). Termination for any reason would become illegal at this stage. Hope you have issued notice to the employer in Form-B and E. If not, please submit it immediately.

If you are covered under ESIC, then please visit your concerned Branch office for the claim, as your wages are paid from ESIC for 6 months.
