Can an employee continue his/her contribution after increasing salary more than 21k

Some of our employees are asking to continue their ESIC contribution to provide ESIC medical benefits to their family members as they don't have any personal mediclaim, but employees have crossed the salary ceiling of 21k.

Please advise and provide the notification/clarification letter if any.

There is no provision for voluntary coverage under ESI in respect of employees who have crossed the ceiling limit of Rs 21,000/- per month. Such employees have to exit immediately, either from 1st April or 1st October.

If an employer continues to contribute incorrectly for two consecutive half-yearly periods, can the employee still avail the benefits?

Yes, employees can avail the benefits in the corresponding benefit periods.

If an employer continues his or her contribution knowingly further to keep the member alive in ESIC to avail the mediclaim facility.

ESI will initiate appropriate action against such employers. Employers have to apply their minds in the coverage/exclusion of employees under the ESI Act.
