Working on Your Day Off: Should You Get Overtime, Comp Time, or Both?

hardik1112
Hey Friends,

My question is, if someone is working on a weekly off, how should it be compensated?

1. Can they be eligible for overtime?
2. Or can they be eligible for compensatory time off?
Or can they be eligible for both overtime and compensatory time off?

Kindly provide me with a solution referencing the rules mentioned in the act.

Thanks,
Hardik

Your question is related to the Factories Act or the Shops and Establishment Act. Please specify your industry and the capacity of the person for whom you are asking the question.

As per the Act, he has to be given compensatory time off on or before the 10th day.

You need to give both compensatory time off within 10 days and double wages.

Hi Hardik,

A compensatory day off on any working day is good to go. For overtime, refer to the law applicable to your establishment.

Thank you.

Dear Hardik,

You must look after the employees; compensatory time off must be provided.

Dear Sir,

As per the act and level, worker level is applicable for overtime, staff is applicable for compensatory off before 10 days. If an employee is not available for compensatory off, he can avail of compensatory off within two months as per the Factory Act.
