Are Ex-Servicemen in Private Jobs Really Exempt from Professional Tax? Seeking Guidance

I have been approached by a few of the ex-servicemen who are working in private companies, stating that they are exempt from Professional Tax. Could you please guide me on this issue? Also, if anyone has any notification regarding this, please share.

Dear Bijay,

Professional Tax is collected by the state government. Therefore, you need to find out whether ex-servicepersons are exempted from the payment of the service tax by your state government. In the meanwhile, you may tell the ex-servicemen to provide the photocopy of the government policy letter on the said exemption.

Under the Karnataka Profession Tax Act, employees who are 60 years and above are exempted from the purview of the Act. Similarly, you can find exemptions based on age, category, etc., as provided in the relevant state-specific Act.

Please check the definition of 'employee' under the Gujarat PT Act for exclusion/exemption.
