Is Sick Leave Really Mandatory for Security Agencies Under Karnataka Labour Act?

If 12 days of sick leave are mandatory for employees, as our security agency falls under the Karnataka Labour Act, we are obligated to provide sick leave to our employees. Please clarify.

A security agency, as an independent entity, would be an "Establishment" under the State Shops and Establishments Act, thereby entitling its employees to all kinds of leave under the Act. However, when they are deputed to the sites of the clients' establishments as contract labor, they would be covered by the leave provisions of the establishment-related labor law applicable thereto.

You need to refer to the Security Guard Act. According to the act, 21 days of leaves or leave encasement is compulsory to be considered, and there is no special provision for sick leave as such. In the month of January, it is compulsory to pay the encashment of leave for unavailed leave.
