I am S. Kumar from Gurgaon. I have been working with Ericsson India since July 2014. I initially joined Ericsson in an off-roll position in July 2014. I was promoted in March 2016 and transitioned to an on-roll position within the company (Essjay Ericsson). All formalities related to this transition have been completed. I possess an offer letter and other documents as proof. I was confirmed as a regular employee after completing a six-month probation period in September '16.
On February 25, 2017, my current project came to an end, and I was recently transferred to a new department. All necessary approvals from the new manager and circle head were obtained through the company portal. Suddenly, I received a call from the HR Team asking me to come to the office on June 2, 2017. I contacted my manager and circle head to inquire about the reason for HR directly contacting me. Both my manager and circle head denied having any knowledge of the situation.
The following day, I went to the office to meet with HR and was informed that I was being called in to sign a resignation letter. Additionally, I was asked to pay three months' gross salary post-resignation without any notice period. When I questioned HR about the reasons for the termination, they were unable to provide a clear explanation. HR suggested discussing the matter with my manager and circle head as they had allegedly provided the information leading to the termination. Upon speaking with my manager and circle head, they confirmed that they had not provided any details regarding termination and that the position was still vacant. I requested some time from HR to comprehend the situation and respond.
On June 19, 2017, I received another call from the HR Team questioning my presence in the office. I clarified that I had not received any termination notification nor had I submitted my resignation within the organization. HR then requested me to fill out an EXIT form on the portal as they were not planning to issue any written termination notice. I informed them that I would not submit a resignation request from my end.
Please advise on the appropriate steps to take in this situation. I have recordings and letters as evidence.
