Please find attached the Supreme Court order dated 9.3.2017, wherein it has been held that once an establishment is covered under any of the excepted categories under section 16 of the PF Act, the authorities cannot compel the establishment to adhere to the provisions of the Act.
In this case, 16 part-time employees of the unit were deemed ineligible for benefits under the State Contributory PF Scheme that governed the remaining regular employees. The Supreme Court emphasized that solely based on this reason, the exemption status of the unit under section 16 cannot be automatically revoked.
