I want to know about PF deductions and on what basis they are calculated. Currently, we are considering basic salary, HRA, conveyance, and mobile allowance. I would also like to understand if ESIC deduction is applicable to the mobile allowance for ESIC deduction.

❖ Security guards without arms have been categorised as ‘Skilled Workers’ as against Semi Skilled Workers as per 2008 notification
❖ Security guards with arms and Security Supervisors have been categorised as ‘Highly Skilled Workers’
What is impact on cost of this new category?

I have a private security agency, and I often participate in government tenders. The problem is that there are two wage rates provided, one by the Central Government and the other by the State Government. In many of the tenders, it's written to follow minimum wages, but they don't specifically state which one - Central or State Government - because they themselves are confused. Now, what should I quote - Central, which is higher, or State, which is lower? Please attach some government resolutions or notifications regarding this with your answer.

Due to an increase in the minimum wage of the central sphere, the companies may increase the salary of unskilled, semi-skilled, skilled, and highly skilled labor, but what about the above executives and officers? It has been found that some companies are adjusting the minimum wage by deducting the allowances. In the notification, there is no clear information about the adjustment of the minimum wages. What is the procedure to prevent the company from adjusting the minimum wage with any allowances? Please advise.

Applicability of Minimum Wages for Private Security Agencies

Dear Mr. Vivek7041, the applicability of Minimum Wages depends upon the status of the establishment/principal employer's area of jurisdiction. If the establishment is registered under State Government Legislation (like under the Delhi Shops and Establishment Act or any Municipal Body of the Delhi Government), then the Minimum Wages of Delhi state will be applicable. On the other hand, if the establishment comes under Central Government purview (like an airport, any government office related to the Central Government, any mines, etc.), then the wages of the Central Government will be applicable.

This refers to your post bearing #21 above. The ESI notification attached by you pertains only to areas in the National Capital Territory of Delhi. The employee threshold limit for the applicability of ESI all over India has been well discussed on this forum many times. Please search using appropriate words, and you will find the correct information on it. I myself have contributed to this topic numerous times and do not wish to provide more input unless there is a need for additional value.

Also, this thread pertains to the Minimum Wage Notification by the Central Government.

Dear Gangadhar,

PF is deducted from your basic salary (12% of basic). HRA and CONVEYANCE are not counted in the Basic salary. ESI is deducted from the gross salary, and the mobile allowance is also a part of the gross.

Clarification on Revised Labor Rates

Hello All,

This is Rommel. I run a security company and I am looking for clarification on the new Central Govt revised labor rates.

Category: Watch and Ward (Without Arms)

1. As per the new rate (VDA + Basic wage):
- Area A is 653
- Area B is 593
- Area C is 506

Category: Watch and Ward (With Arms)

2. As per the new rate (VDA + Basic wage):
- Area A is 710
- Area B is 653
- Area C is 593

Category: Employment of Sweeping and Cleaning

3. As per the new rate (VDA + Basic wage):
- Area A is 536
- Area B is 448
- Area C is 359

Are these rates correct? The reason I am having doubts is that they are on the very high side compared to the previous rates from the Central Govt.

Can anyone please comment? I am attaching the new Central Govt ORDER for your reference. I would be happy if anyone could provide me with a contact number so that I can talk directly and get this matter clarified as I need to bid for new tenders and require this clarification urgently.
