From Which Date 26 Weeks Maternity Leave Is Applicable?

Hello to all,

My name is Shweta, and I work as an Assistant Manager-HR in a private company. I have a serious concern regarding the amendment in the Maternity Benefit Act. I am about to take maternity leave starting from December 16, 2016.

However, I am unsure about the specific date from which the 26 weeks of maternity leave will be applicable. To my understanding, it is still in the process of being finalized. Please guide me if anyone has any latest updates on this matter.

The new amendment is applicable with effect from 11th August 2016.

Friends,

Let us not create confusion. It is only a bill which is pending in Parliament. It will be effective only after it is passed in Parliament, gets assent of the President, and a notification is issued to this effect.

Dear RSJLEXSYS,

Kindly note that recently, the TN government enhanced the maternity leave only for government servants. It would not be applicable for private sectors.

I am in a private limited company, but my company has refused to pay 3 months of paid maternity leave. I have been working with this organization for 4 years. What should I do? Please suggest.

Hi Gadekarlina,

Please download the MB Act from the internet and provide them with a copy of it. Explain to them that you are entitled to it as per the law. You can also email it to them, which will serve as a record. If they still refuse, inform the labor officer in your local area. He will take it up with your management and ensure enforcement.

It is just a proposal that they have passed in parliament. We are waiting for the notification.

Dear Members,

The notification shared by FC Vadodara was passed in Lok Sabha and clearly mentioned as "To be introduced in the Rajya Sabha." However, please find attached the formal notification (being introduced in the Rajya Sabha as well).

Hope this will resolve the query. Experienced members can shed more light.

It is not sufficient that the Bill is approved and passed in the Rajya Sabha; it needs to be assented to by the President and duly notified in the Gazette.
