Maternity Leave Pay in India: What Salary Components Are Covered for Contractual Staff?

Dear All,

Please let me know, when a female employee is on maternity leave for six months, what proportion of her salary will be paid? What is the norm for a private limited company in India where all employees are contractual staff? Is it Basic + DA + HRA or gross salary including other allowances, or only basic pay?

Please suggest.

She is not covered under ESI. Maternity benefit Act is applicable to her.

In our salary structure, there are other allowances and medical allowances, including the above portion. Will it be deducted from her salary? Does this mean Medical Allowance and other allowances?

No deduction will be done, and you have to pay all the allowances you have in gross. Actually, you have to pay her gross salary.
