I wanted to know from seniors and other experts if the 50% wages payable as compensation for temporary disablement is to be paid over and above regular wage or sick wages, or is only the compensation payable?
Under section 4(1)(d), (2), and (3), compensation shall be a half-monthly payment of the sum equivalent to 25% of monthly wages for the employee. This means that 25% shall be payable every half month, specifically on the 16th day.
Only the compensation is payable. So if the company has rules for providing full salary during disablement, then the compensation is not payable because the payment made is already higher than what the law requires you to give.
