MOBILE THEFT BY CO WORKER

Hello Friends,
I Am working as a Accountant in a Pvt. company my phone is stolen from office by an employee of the office.
I have proof of who theft the phone by CCTV phutez & Now the thief is out of reachable from us. He crossed away.
I want to know that What Are My Rights..?
Who responsible for it.
Company gives the money for my phone because Employee hire from company.

If you have evidence in the form of CCTV footage of the theft of your mobile, then on the strength of this evidence, you may file a police complaint. Let police investigate and nab the culprit.
Workplace thefts are common. Therefore, it is the duty of the individual employee to care of his/her belongings. In your case what has happened is "theft" and not "robbery". Most of the theft cases arise out of individual's negligence. Persons lower their guard and allow thieves to take advantage of it. Has something happened in your case? Did you leave your mobile phone on the work desk and went somewhere else?
Raising a claim to the company for loss of your property because the loss happened in the company premises may not be acceptable. While company premises are not public places like railway station or airport, it not private also like anyone's home. Therefore, it remains to be seen how company entertains your claim.

I file police complaint But police says we can't go there because he moves to Bihar & I am in Maharashtra company says I am not responsible If I complaint in police against company It is correct or not.

Dear Shubh,
Mobile phone was your personal belonging. It was your responsibility to take care of it. Company cannot be held responsible for the loss. Therefore, it would be too unreasonable to sue company for the loss.
Thefts are common anywhere and everywhere. Each one of us has lost something. I understand your heartburn but take it as lesson and move on. However, making complaint against company could land in further trouble and it could jeopardise your career. Whether police will accept your complaint is a different matter.

I also thinking it is a lesson to me & others in my office That keep your things With You I am moving On.
But One thing is that The thief is contacting us & says that he comes back & he is accepting his mistake & wants sorry for his deed what I do with him If he comes back & return my cell.
