Navigating PF and ESI Obligations for Employees Who Left or Passed Away – Need Guidance

Dear Sir/Madam,

There are two different cases.

1. One employee worked only 6 days in a month (April 2016) and he left the job; he said that he will not come to work. In this case, do we need to pay PF and ESI?

2. Another employee worked for 4 days in April 2016; unfortunately, he passed away (on the 4th night). Do we need to pay PF and ESI for him? I have prepared PF and ESI dues for the 15th for PF and the 21st for ESI. Please advise as soon as possible.

Yes, you have to contribute for both cases.

1) You have to contribute for those 6 days (If the last date is the 6th, then till April 6) and show the date of leaving as April 6.

2) You have to contribute for those 4 days (If the last date is the 4th, then till April 6) and show the date of leaving as April 4 and the reason as Death.

In addition, please note that the person who died will be entitled to ESIC benefits, and I think also EDLI.
