How Do You Notify an Employee About Accepted Voluntary Retrenchment?

Dear Colleagues,

Could you please assist with a sample letter notifying an employee that his offer for voluntary retrenchment has been accepted.

Well, gentlemen, before raising a query, you could have at least done some amount of Google search or searched this forum to update yourself about the concept of "retrenchment." Learned members of this forum like Mr. Umakanthan, Mr. B. Saikumar, Mr. Nathrao, etc., have given their replies on this subject many times. There is nothing like "voluntary retrenchment." To improve your knowledge on retrenchment, you may check the following link: http://www.legalservicesindia.com/ar...947-773-1.html.

My reply is based on the assumption that you are from India. If not, then you may have to follow the labor laws of your country.

Thanks,

Dear Steogeb,

Voluntary Retrenchment - Voluntary Retrenchment Scheme is designed differently according to the organizations. Based on the scheme, a letter will be drafted and issued to the retrenched employee. Evaluate the scheme's terms and conditions for retrenchment before drafting the final letter to issue to the employee.

Dear Stephen,

There is no concept of 'voluntary retrenchment' recognized under the law, as rightly said by Mr. Dinesh. Probably you must be referring to voluntary retirement. If so, this will be a scheme to be framed by the employer offering some compensation to the employees willing to opt for the scheme. You cannot compel employees to opt for the scheme, as the very name of the scheme suggests that it is voluntary.

Retrenchment is initiated by employers (if employees are found surplus owing to various reasons), whereas Voluntary Retirement is initiated by the employees (at least on records!). You have mixed both and created a new term, something like Suicide Murder!

Best wishes

Dear Stephen,

There is a difference between voluntary retirement and voluntary retrenchment. In my opinion, there is no such thing as voluntary retrenchment. The retrenchment procedure is outlined in the Factory Act and must follow specific steps. The voluntary clause does not provide any provisions for retrenchment.

Thank you.

Retrenchment is through a legal process as detailed in the I.D. Act - refer to chapter VA & VB. If you are referring to Voluntary Retirement, also known as Voluntary Separation, it is a scheme designed by the company either on their own or in consultation with the union if a union exists. Both are for shedding surplus manpower or right-sizing the organization's workforce.
