What is the procedure to cover contract labor in ESI and PF? What are the names of the forms? What is the eligibility criteria? Please.

Enrolling Contract Labor in ESI and EPF

There are no separate forms for enrolling only contract labor in ESI or EPF. If these contract workers are engaged through a contractor and he has a separate ESI/PF registration, he will enroll the workers under his registration and pay the contributions. You just need to ensure that the monthly contributions are being paid on time before the payment to the contractor is made from your office.

If he does not have any ESI/PF registration, then register the workers under your own registration number, just like your directly employed workers are registered.

We are providing canteen services, but our employee strength is below 20. Should we apply for ESIC and PF since our client requires this for the contract? Please advise.

1. Sir, please indicate complete facts about the establishment in which you have opened a canteen or for which you want to do canteen contract work. For example, whether the said establishment is an establishment/shop, factory, etc.

2. Whether the said establishment is already covered under ESI or EPF.

3. Whether electric power, such as a deep-freezer, and gas cylinder are being used in the canteen.

Separate ESI/PF Registration for Contract Labor

Whether it is a contract for service or of service, it is advisable to obtain separate ESI/PF registration for yourself. To meet the threshold limit of manpower, you can show a sufficient number of people as employed for just one day in the muster roll and treat them as having left the next day. You can show some wages paid to these casual laborers on that day and pay contributions accordingly. Once registered, you will maintain the registration even if the number of workers falls below 20 or 10, as the case may be.
