Can I Claim Gratuity After a Promotion from Trainee to Jr. Officer? Seeking Advice from Seniors

Hello Seniors,

I was working as a management trainee from 2011 to 2012, upon which my designation changed to Jr. officer. Can I claim for gratuity?

Hi Buddy,

Yes, if you have completed 5 years of continuous service, then you are eligible to claim gratuity regardless of your designation.

On exit from the company and upon completing 5 years of continuous service, you become eligible to claim gratuity.

I am not sure if Mr. Kumaran Praveen is right. While designation is not important in gratuity eligibility, the status as an employee is important. Depending upon the terms of engagement, a Management Trainee may or may not be treated as an employee. I would suggest checking the status during the training period.

If the company has absorbed you as a permanent employee of the organization after the successful completion of the training period, then your date of joining will be taken from the date of joining as a trainee for the purpose of gratuity, subject to completion of 5 years. However, all benefits other than gratuity shall be considered from the date of absorption of your service.
