How Can We Legally Address Our Unpaid Salaries for the Past Three Months?

Sir,

We have not been paid our salary for the last three months, and we have been requesting the management to pay us. However, they keep saying that the payment will be made in 2 to 3 days, and this situation has been recurring for the past three months.

We are currently working in a location outside our home state. Is it possible for us to approach the High Court or the Labour Court in our home state? Alternatively, could you advise us on any other ways we can receive our payment?

Dear Vijay, Any workman can claim unpaid wages from the employer through their Home Town/District Labour Office. For this, you must have proof of employment (ID card) with complete details of the organization you worked for, and the Muster Card for the period worked. If the concerned official has signed the Muster Card, the complaint will hold more value.

Staff members earning a salary of less than Rs. 18,000 per month can approach the labor office in their district. Others can seek resolution through the Civil Court of Law.

No. Please check with your ex-employer's jurisdiction. If they have any jurisdiction limits, then you cannot file in other areas.

Sir, meri company ne layoff aur shutdown diya hai. Aur Hume bahar kar diya hai. Par jab hisab dene ka time ayega to Hume 1 employees Ko kitna milana chahiye. Hum 1400 log permanent hain. Mera basic 8352 hai aur gross salary 22500 hai. Mujhe 12 years company mein kaam kiya hai. Company close karne ki process chal rahi hai. Kripya hisab ka ek structure bataiye.
