Coverage Under the ESI Act, 1948

1. Coverage under the ESI Act, 1948 is compulsory if your establishment or factory is located in an implemented area and employs 10 or more persons. For employees covered under the ESI Act, there is no need, in my opinion, to obtain any medical insurance policy. However, for employees earning more than Rs. 15,000 per month and not covered under the said Act, you can consider getting them covered under a medical insurance policy.

2. It is also important, in my opinion, to comply with the instructions, Act, Rules, and Regulations of ESIC authorities if your unit is covered or coverable under the said Act. This is crucial to avoid penalties, damages, or prosecution in cases of non-compliance.

There cannot be a second thought when ESIC is statutory. However, you can cover all your employees under mediclaim insurance as an additional benefit.

In the same query, if ESIC dispensary is not located nearby, what can we do if employees are not interested and we have only 30 employees? What can we do?

Sir, if there is any shortcoming in ESI medical services, including excessive distance to the ESI dispensary, you can make a representation to the appropriate authorities for such improvements. Statutory provisions of any law are not optional.
