Family Members Working Together: Are They Both Eligible for Separate ESI Benefits?

deeparayncyan
Can two workers from the same family (e.g., husband and wife) working in the same factory be entitled to ESI separately? Is there any legal care that one should take in this regard?

---

In this scenario, both workers can be entitled to ESI separately as long as they meet the eligibility criteria individually. However, it is essential to ensure that all necessary documentation and information are accurately provided to avoid any potential legal issues. It is advisable to consult with the HR department or legal counsel to understand any specific regulations or considerations that may apply in such cases.

Dear Deeparayncyan,

What about their ESI deduction? If you deduct their ESI, then obviously they are eligible for the ESI facility.

Thanks,

Social Security Benefits Under the ESI Act of 1948

1. Social security benefits, such as those under the ESI Act of 1948, are payable as a result of contributions by individual employees, with eligibility based on these contributions. If two insured persons who are related to each other (such as husband and wife, or brother and sister, etc.) are working in the same unit, it makes no difference.

2. If both a husband and wife are working in the same organization and both are covered under ESI, they will receive their benefits separately when the occasion arises, depending on the applicable rates. However, an insured woman, whether a wife or sister, will also be entitled to maternity benefits.

There will be many such cases of both husband and wife being insured persons (IPs) due to their employment in a firm covered by the Employee's State Insurance Corporation (ESIC).

Please refer to the ESIC Scheme Benefits page for more information: [ESIC Scheme | Benefits | Employee's State Insurance Corporation](http://www.esic.nic.in/benefits.php)
