I am from the HR department of a reputed company in Kolkata. Recently, I have been facing issues with employees who are remaining absent without any prior intimation. Such actions are really disturbing the working environment and affecting production. Can anyone provide a solution to address this scenario? Is there a way to legally bind employees? Can we take legal actions against employees for not responding to phone calls or emails after their unapproved absence?

In the aforementioned post, I outlined the causes of employee absenteeism. It is crucial to address these underlying causes first. Resorting to legal actions is merely a temporary solution and will likely prove ineffective in the long run.

Hello Dipak, you can take action on disciplinary matters. Being absent without giving any intimation is considered indisciplinary. In my opinion, you should first identify the actual reasons behind their behavior and then try to resolve the issue.

You may take suitable disciplinary proceedings against the employee subject to the certified standing orders of our company if the employee is a workman covered under the same. In other cases, you can take proper disciplinary proceedings in compliance with natural justice.

The only way out of this problem is to frame a Code of Conduct and obtain a signature from each and every employee. This can be done either prior to joining by mentioning the clause in the appointment letter or after joining through the Code of Conduct.
