Use Of Maternity Benefit For Only 3 Women Employee

Hi
I am working in Manufacturing company and we have total 3 women employee working in the office, are we applicable to use maternity benefits as all the women employee don't cover under ESIC.

Dear Hrituja,
Provisions of Maternity Benefit Act, 1961 or ESI, 1948 are applicable irrespective of the strength of women employees. If women employees are not covered under ESI then provisions of MBA, 1961 automatically become applicable.

You have to pay maternity benefits as per MB Act 1961 to those lady employees not covered under ESI scheme.The number of women employees being three make no difference for the applicability of the Act.
