HR Policies Regarding Confirmation After Completion Of Probation Period

Dear All Professionals,

I am seeking your advise regarding confirmation of a new employee after successfully completion of Probation period. I am working in MNC headquaterd in New Delhi and based at several locations in India and abroad too. I am working in this company past few months and as per company policy I should have been confirmed after 6 months with revision in my compensation and my designation as per their Hr policies and appointment letter. But till date no one talks about the confirmation neither no one has reviewed my performance that usually happens in companies and then your future and road path is decided in the company after discussing with the immediate boss, employee and then HR decides on percentage of increase of compensation as per the reviews and feedback received from several sources. But here nothing is happening like this and infact employees who joined with me in several dept are facing the same issues. This company has got very bad track record of torturing and harassing the employees and firing them or pushing them to leave the company, infact several past employees has filed a legal case on the company in the past and company had to pay the compensation as penalty but still condition are even worse. Company has even reputation of holding the salaries of the employees who try to leave the organisation and even their exit documentation are jeopardized. To bring to your notice this company even dont participate in provident fund scheme, so no benefits at all given to the employees with lots of agony and frustration and everyday feeling of un secureness of loosing your job any time without a valid and strong reason.

I request you all forum members to share their valuable and detailed insight on this case as it will help me and navigate my further actions soon.Hoping to get your valuable feedback on this request.

Hope you have written this post under fictitious name and have not used your real name. If that is the case then please make this post "Anonymous".
If you have not been confirmed after completion of the probation period then why not to write mail to HR and ask for clarification? Keep the printout of the mail with you for your records.
Secondly, there appear to be so many issues with this MNC. If that company is providing Provident Fund (PF) facility to the employees, if the employees are removed at whims, if the past employees have filed lawsuits against the company then the situation merits full disclosure of the name of the company and industry in which it belongs. There is no need to hide it. This is what social media is for.

Dear Mr Divekar,
Thanks for your swift response and I have already written to the designated HR but they are mere puppets of managements so dont speak a word against management as they are having blast in the company without even thinking about other employees and once I get to have better solution to my scenario I will definitely point the name of the company in the Forum that might be beneficial for future job hunters, but still I need the road map to tackle the current situation.

If the company is as bad as you say it is, then why are you trying to get confirmed there ?
Why are you not instead trying to change your job and leave at the earliest ?
If you are under probation and not confirmed, your notice period will also be very less

Thanks, I want to break their myth that not all employees are helpless and I want to move to next job with an raise in my compensation and designation. Hope it makes sense.

If the company is not implementing EPF benefits to its employees kindly bring this to the notice of the EPF authorities so that atleast this portion of the problem is quickly solved.

All this problem in India with regard to confirmation is because we do not have a law on probation/confirmation applicable uniformly except in companies with certified Standing Orders.

It is duty and responsibility of the employer and personnel designated by employer to initiate and complete the appraisal in time so that the employee gets confirmation letter on close of office hours of the probation period.
You should disclose the name of such unscrupulous employers so that fellow members and countrymen are cautioned.
You can escalate to next level of appointing authority,MD.....
Such matters can also be taken up effectively thru Employees/Trade unions.

What do you think will happen ?
If you file a case or a complaint against the company, what do you think will be the first action they will undertake ? They will terminate your services. You expect the next job you will apply for will be happy to recruit you with a termination letter ? And what do you think will happen in case of a background verification ?
On what grounds will you file a case against the company?
On grounds that they are not following what other employers are doing ?
Is there a law saying that they have to confirm you, or that need to do appraisal ? Or that they need to give you an increment ?

The terms of appointment mention conditions of confirmation. If it is mentioned therein that 'unless confirmed in writing you will continue to remain on probation' then you have to wait for about 1 month after mentioned probation period and pose as to what is happening about your confirmation.
