Terminating an Employee for Misconduct: How Much Notice is Really Needed?

Hello Sir/Madam, this is Jyothi. I'm working as an HR Executive in a company. I want to know if an organization wants to terminate an employee due to misconduct, how many days' notice should be given to the employee? Is there an option to terminate an employee immediately without prior notification?

Termination for Misconduct Under the State Shops and Establishment Act

Under the State Shops and Establishment Act, it is generally provided that no notice is required to be given while terminating for misconduct. However, this should be done after a proper domestic inquiry. Similarly, Model Standing Orders also provide guidance on this matter.

Misconduct and Termination Procedures

The misconduct should be as listed in the Misconduct section of the standing orders applicable to the establishment (certified/Model). The procedure is explained in Section 14 of the Model Standing Orders.
