How Will the Apprentices (Amendment) Act 2014 Impact Your Business Practices?

Please find attached the Apprentices (Amendment) Act 2014, which received the assent of the President on 5th December 2014. It will come into force on a date to be notified by the Government in the Official Gazette. The major changes are as follows:

- Providing that establishments operating in four or more States will come under the purview of the Directorate General of Employment & Training;
- Prescribing the number of apprentices to be engaged at the establishment level instead of trade-wise;
- Allowing non-engineering graduates and diploma holders to undergo apprenticeship training;
- Allowing employers to introduce new courses (optional trades) based on demand;
- Empowering employers to determine the qualifications, period of apprenticeship training, conduct tests, issue certificates, and set other conditions for apprentices in optional trades;
- Simplifying the procedure for registering contract apprenticeship training;
- Facilitating information exchange through a portal-site;
- Allowing employers to engage apprentices from other States;
- Allowing employers to create their policies for recruiting apprentices;
- Imposing penalties in the form of fines only;
- Granting ex-post facto rule-making powers to aid in recognizing training initiated before the notification of new trades under the Act;
- Permitting participation in optional examinations and certification by any competent agency.

The amendment in the Act has come into force from December 22, 2014.
