How Can I Recover My Unpaid Salary After Being Let Go from a Call Center?

I was asked to leave my last organization 46 days ago. As I was not a permanent employee, they did not provide me with any reason. However, they gave me a Release Letter and an email confirmation stating that I would receive my salary until my last working day after 45 days from the date of my forced release. It has been 46 days now, and I have not received my salary. I have sent them two emails requesting the release of my salary within a 24-hour window, but I have not received any response from them.

Seeking Advice on Salary Recovery

Kindly suggest how I should proceed to obtain my salary from them. I am willing to file a legal suit if necessary. The organization is a small Call Center in Kolkata, and I was working there as a Process Trainer.

You have not specified for how many days you worked and for how many days the payment of salary is outstanding. You are entitled to receive a salary for your last working day.

Sufficient time has elapsed since your departure from the company. I recommend that you approach the labor officer in your area. Bring along sufficient proof of your employment. Speak with the officer and submit a written application regarding the non-payment of salary. Based on your letter, the labor officer will communicate with the company authorities and attempt to resolve the issue. If the matter remains unresolved, then you may consider taking legal action.

Thank you for the information. I joined this company on 6th August 2014, and they asked me to leave the organization on 27th September 2014, stating that as they don't have a training batch, they don't need a trainer. They provided me with my August salary on 20th September 2014, as the first salary after 45 days, and their salary cycle is from the 1st to the 31st of every month. They sent me my Release Letter on 1st October 2014 and confirmed that they shall pay my salary from 1st September 2014 till my last working day, which is 27th September 2014.

Compensation Inquiry

Can I ask for one month more compensation from them as they asked me to leave without letting me serve the one-month notice period? If you want, I can send you my Offer Letter so you can review the clause of it if you want.

From your latest post, it emerges that payment for your salary is due from 1st to 27th September 2014. They should have cleared your dues at the time of exit or at the time of disbursement of salary for September 2014 or sometime later. Still, they have not done that. Continue your correspondence with them. Go and meet them personally. If nothing works, then only approach the labor officer of your area. Try to resolve the issue amicably.

Notice Pay and Probation Period

As far as one month's notice pay is concerned, you need to check the clauses of the appointment letter. Possibly you were on probation. During the probation period, the company can remove you with short or even the shortest notice. Nevertheless, at this juncture, the most important thing for you is to recover the salary for the actual period you have worked. Recovery of notice pay, even if you are eligible for that, comes next.
