Hi,

There are two slabs:

For Employees drawing wages up to and inclusive of Rs. 3000/- per month:
- Employee Contribution: Rs. 6/- per employee
- Employer Contribution: Rs. 18/- per employee

For Employees drawing wages exceeding Rs. 3000/- per month:
- Employee Contribution: Rs. 12/- per employee
- Employer Contribution: Rs. 36/- per employee

Employee (EE) Contribution can be deducted from the employee's salary. Contributions are payable twice a year (For the half-year ending in June and December of every year).

I am attaching a JPEG file of the form cum return, which is self-explanatory. However, a word of caution to all who will be using it to file their returns and contributions for the first time.

We are in a duel with the authorities as they interpret designations and job descriptions according to their thinking. Therefore, if you decide to include officers/executives as supervisors when filing for the first time, please have a document written somewhere and place it in the MLWF file so that anyone in the future can read this carefully. Otherwise, when your workforce grows, they will ask you to include officers as workers. So, be careful.

Please tell me, is it applicable in Maharashtra state or all the states? I want to know about Delhi, U.P., Haryana & Rajasthan.

Hi,

In U.P., there is a Labour Welfare Act, but in this Act, there is no regular contribution to be paid. Only if an employee leaves without taking his full payment, his part of the payment (unpaid wages/salary) is to be deposited under this act.

In Haryana, the Labour Welfare Fund contribution is INR 15 per month per employee (INR 5 employee contribution + INR 10 employer contribution) effective from 1st April 2007.

Hi Jay,

LWF is applicable only for the workman category as it does not need to be collected from executives. However, it is at the sole discretion of the management whether to collect the money from every employee towards the Labour Welfare Fund.

As far as Karnataka is concerned:
- Employee Contribution is Rs. 3.
- Employer Contribution is Rs. 6.
To be submitted along with Form V.

Labour Welfare in Delhi:

As per the provisions of the said Act, any shop, establishment, or factory that employs five or more persons on any working day during the preceding 12 months has a statutory obligation to deposit:
a) Fines realized from employees,
b) Unpaid accumulations,
c) Contribution of employees at Rs. 0.75 per employee per six months,
d) Contribution of the employer at Rs. 2.25 per employee per six months.

Hi,

In Haryana, there is a Rs 5/month employee contribution and a Rs 10/month employer contribution towards the welfare fund. Every salaried employee falls under its ambit. Returns are to be submitted on a quarterly basis as per the Haryana Labour Welfare Act.

Hi Dear,

LWF is calculated under the Punjab & Haryana LWF Act as follows:

From employee = Rs. 5.00
From employer = Rs. 10.00
Total = Rs. 15.00/month

The same amount is deposited under the LWF Return Act (Jan to Jun & Jul to Dec).

Dear Mohd. Majibul,

The rate of contribution as shown by you relates to Haryana, and this contribution amount is to be deposited by 31st December every year. The Government of Haryana has also given a one-month grace period, and accordingly, this amount may be deposited without interest up to 31st January.
