Factory Admin Office and Raw Material Store: Which Act Applies – Factories or Shops and Establishments?

sakshar sarbajna
Hello everyone, in our factory, the raw material store and admin office are inside the premises. So, will the admin office and R.M. store fall under the Factories Act or the Shops and Establishments Act?
snparadkar
It will come under the Factory's Act. If the admin office and RM store are not related to the factory's operations, then it will come under the Shops and Establishment Act.

You are requested to read the definition of 'factory' defined under Section 2(m) of the Factories Act carefully and interpret it correctly. This definition states that a factory means any premises, including the precincts. According to this definition, all activities carried out within the premises and precincts of a factory are covered under the definition of a factory.

Thank you.

All the offices situated within the factory precincts/premises will be covered under the Factories Act. If an office belongs to a factory established in a nearby town/city, then it will be covered under the Shops and Establishment Act for the purpose of licensing from the Labor Department only. All the other labor acts will apply on par with factory employees.

It cannot be so. If a premise is an establishment covered under the Shop Act, it is so not only for the purpose of registration but for all provisions of the Shop Act. Usually, if a factory has its offices outside the factory premises, they will be, for the sake of the law, under the Shop Act. However, other working conditions will be the same for its factory and offices, especially if the staff are transferable.

If an administrative office is running within the premises of a factory, it does not need a license under the A.P. Shops and Establishments Act of 1988. However, if a factory is located on the outskirts of a town and its office, meaning the company office, is in the town, then it is necessary to apply for a license under the AP Shops and Establishments Act. This information is authenticated. Thank you.

All departments that are within the premises of the factory will come under the Factories Act.

Whatever office, process, storage, or any other activity is within the campus of the factory, all these provisions of the Factory Act would be applicable, barring exceptional cases.

If the admin office or raw material store is located within the factory premises, it will definitely be part of the factory, and as such, The Factories Act is applicable.
