How Should Leave Be Allocated After Completing Probation in June?

Our company gives 6 CL, 6 SL, and 12 EL, which is applicable from January to December.

Query on Leave Allocation Post-Probation

My query is, if a newly joined person has completed the probation period of 6 months, i.e., from January, and we have confirmed him in the month of June, then how many CL, EL, and SL can be given?

First of all, the allocation of leaves depends on the company's policies. Every company has its own policy.

In a general perspective, when an employee joins in January, he/she will get 6 CL & 6 SL. EL will be given after the completion of 240 working days. EL for the new employee will be allocated from Jan '15. The balance of EL will be allocated to the new employee from his/her date of joining.

The reason CL & SL are allocated to a new employee is that an employee might need some leaves during their probation period for sickness or for some serious personal reasons.

When referring to such cases in the context of company policies, one should first understand the applicable provisions of the relevant laws. When providing advice or comments on queries, these legal provisions should be quoted or referenced. Company policies should never override the applicable provisions of the relevant laws.

For example, the company policy allows for CL-6, SL-6, and EL-12, which are fewer than the applicable provisions. Surprisingly, no objections have been raised or advice given on this matter. If I am not mistaken, employees are entitled to 7 CL/SL days and 1 EL day after 20 working days (with a minimum of 240 working days in a calendar year for full-time employees and 2/3rd working days for others). CL/SL can be granted on a pro-rata basis, while earned leave from the current year can be taken in the following year.
