Can My Former Company Legally Demand Three Months' Salary Back After My Departure?

Pratap K
After relieving me on March 31st, the company wants the salary back for three months, stating that I left the job in January. Can the company take any action to retrieve the salary after my departure? They paid me up until March 31st, and I have both salary slips and relieving letters. Can they recover the salary in any circumstance, regardless of whether I go to the office or not?

If the company has issued you a relieving letter, they should not be asking you for the salary for the period you have not served. After issuing exit documents, companies typically deduct any pending dues from the employee's side, which is always deducted from the employee's full and final settlement.

Has the company paid you your full and final settlement? If not, then the company has the right to ask you for payment of 3 months' salary. If they have paid you, then you need to talk to them and settle an amount with them or pay them the entire amount as desired.
