Are Managers Entitled to Overtime Pay? Urgent Help Needed on Legal Rules and Case Laws

Hi all, I want to know if supervisors, assistant managers, and managers are eligible for overtime wages. If yes, under which Act, rules, etc.? Are there any case laws to justify that managers are eligible or vice versa? Please, this is urgent.

I went through the ID Act, Factories Act, and Karnataka S & E Act. Do the definitions of workmen or employees under the Factories Act or S & E Act include these above-mentioned category levels?

Please try to understand. Overtime is given to the workers and not for the managerial/supervisory staff. Time fixation is mainly done for those who are doing hard and strenuous work. If they continue for more than a certain time period, it will reduce their effectiveness, productivity, and may lead to accidents in the workplace. To avoid such exploitation, the government has implemented stringent rules. Since managerial/supervisory staff are qualified and their work is not as physically stressful, it will not harm the company. Therefore, overtime is intended for the workers.

While creating such acts, rules, and regulations, the government does so sensibly. However, whether these rules are being followed during implementation is in the hands of the authorities.

That's the reason why workers receive bonuses only, while managerial staff do not. Instead, they receive ex-gratia for the period.

Overtime Wages Under the Factories Act

As per the Factories Act, overtime wages are to be paid to workers. According to this Act, all employees except the following categories are considered workers:

• Occupier and Manager as per the Factory licence.
• Persons defined and declared under section 64 of the Act, if their monthly salary is above Rs 18,000/- pm.

It's totally dependent on company policy. Many companies pay overtime to workers, as well as supervisors and above levels, while some companies only pay workers. However, very few companies pay overtime to managerial levels.

What about a medical officer in a PSU who does stressful work for a long period, sometimes compromising on sleep, and is also in a managerial capacity?
