Can Our Office Operate in a Residential Apartment Without Registering Under the West Bengal Shop & Establishment Act?

My MNC company is doing business in West Bengal through a distributor. We maintain an office with office staff on third-party payroll. We have 20 field staff and managers on the payroll. Can such an office run in a residential apartment without registering in the West Bengal Shop & Establishment? All holidays are followed as per the West Bengal holiday schedule. If not, then what needs to be done?

Of course not. It's absolutely illegal to run a business without registering. Please visit a CA and have the company registered, and they will guide you on all legal aspects.

Dear Mr. Mitra, Thanks for guiding us. Please furnish what could be the legal penalty if it has not been followed since the company was incorporated, i.e., from 2001 till date.
