New Job Probation: Can I Access PF and ESI Benefits Before Three Months?

mitra1111110@yahoo.co.in
I joined a company recently. So, can I avail the facilities of PF & ESI because my three-month probation period has not been completed yet? Is PF applicable to me before three months of joining? If not, then why?

Prashant is right; there is no such clause. A probationer is also considered a workman, and whatever privileges are provided to workmen are applicable to probationers as well.

There are no exceptions or exemptions against the probation period. Both PF and ESI, where applicable, are applicable from the date of joining, subject to ceilings.

I presume your basic salary is less than Rs. 6,500/- and your gross salary is less than Rs. 15,000/- per month, and the company is covered under PF/ESIC. If yes, then you are eligible for PF/ESIC (exceptions apply under the Apprentice Act). Under ESIC, you can claim cash benefits only once you have contributed for a certain number of months; otherwise, medical benefits are available.
