Navigating PF and FNF Settlement: How Can I Recover My Money After Two Years?

I worked in an IT company for one year, and a new company offered me good pay. So, I informed them that I can't provide a relieving letter or documents from my previous company. They accepted this and skipped that requirement.

My previous company was deducting PF, and I have a PF Account Number. At this stage, I can't go to my previous office to get my FNF (Full and Final settlement) as I didn't give them notice. I assume they won't provide it if I ask now.

Is it possible to get my money back? Whom should I contact at this point? It's been almost two years now. Please help!

Yes, you can get back your PF money to your account where you are working, or you can withdraw by sending the forms 10c and 19. If you want to transfer, send form 13 to your company. If there is no response, send a notice. If you don't want to go through all this, you can undersign the form with a gazetted officer and submit it to the PF office to get the amount back.

You can withdraw the PF money. However, it is better to transfer the PF money accumulated in your old PF account and merge it with the present PF account number. You have to fill up Form No. 13 Revised and submit it to your present employer. The HR of the present employer will do the needful.

Advice on PF Account Transfer

Since you have to serve for a longer period in your career, I advise you to always get your PF account transferred to a new establishment whenever there is a change in job. You simply need to inform the new employer by filling out the required forms.

Benefits of Continuous PF Contributions

Contributions for 10 years will entitle you to pensionary benefits, which is a better option rather than making PF withdrawals each time.

Thanks for your suggestions. However, I already discussed this with my current employer, and they said, "You should have clearance from your previous company to get this transferred. Therefore, I asked them to open a new account." (This means my current employer can't help with it.)

Also, my previous company is saying that I have to pay a huge amount against my notice period, then they will sign my PF form; otherwise, no relieving and no clearance. (They are asking for a very large amount, five times my PF, so it is not possible.)

I read, "Undersign the form with a gazetted officer and submit it to the PF office; you can get the amount back." Is it possible? If yes, then please elaborate on the process for me.

Employer's Obligation to Accept Form-11

In my opinion, a new employer has no power to reject Form-11 submitted by a new employee wherein details of their previous employment and PF account number are mentioned. The new employer has to accept Form 13 for transferring the PF amount from the account of the earlier employer.

Claim Settlement Process

Similarly, one can get their claim settled if applied within one year of leaving the job by getting their form attested by any gazetted officer or bank manager, along with a blank canceled cheque and stating reasons for not getting it attested by the old employer.

I worked at a Birla company from September 1, 1989, to May 12, 2005, and subsequently left. I have withdrawn my PF but do not know my pension account number. How can I transfer/attach my pension account to my current company?

Please note that from 2005 to 2012, I worked in some organizations where there was no PF. Kindly advise.

I left my previous company 2 years ago and joined the current company. Therefore, I believe that my current company cannot help with the transfer. Additionally, based on your previous comment that "one can get their claim settled if applied within one year of leaving the job by getting their form attested from any gazetted officer or bank manager," does this mean I cannot get my PF now?

PF Withdrawal Restrictions

In this case, you can't withdraw your PF amount because you are working with another company. As per the act, a member of PF can only withdraw if, at the time of filling the form, they have not been in a job for 2 months. After leaving the job, transfer is the only option. Fill out Form 23 for this.

Dear Harry,

Don't make guesses. It is the legal obligation of an employer to deduct and remit the P.F. contribution to the P.F. Regional Office. You can send a letter from your present employer along with a filled P.F. Transfer Form No. 13 and keep a copy of the same with you. Please take an acknowledgment of the receipt from the previous employer. You can then transfer back your P.F. amounts to your current P.F. account. This is the best option. If they deny, you can send an application to the P.F. Regional Commissioner and Labor Commissioner, attaching a copy of the letter you sent for transferring P.F. along with the P.F. Transfer Form.

If you want to withdraw your P.F., you should write an application and send it by Registered Post with a filled-up Withdrawal Form No. 19. Ensure it is acknowledged by the recipient. If they deny, follow the same procedure as mentioned in the paragraph above.

You can also check your P.F. number through the P.F. Regional Office.

Hi Harry,

The PF deduction is as per the law. You can either deduct the PF amount or transfer the same. The PF number shall be available in your salary slip. If the same is not mentioned, you can very well call up your employer and ask him for the same. He cannot deny the same.

For the transfer of PF, you can use Form 13, and for withdrawal of the same, you can go for Form 19 and Form 10C.

I left an organization two months ago, and they provided me with a form that you mentioned. However, in that form, there is a clause stating: "I hereby declare that I am not working in any organization for the last two months after leaving this organization." What does this mean? I left my previous employer and joined another where PF is applicable, but I want to withdraw from the previous one. Please guide me.

Dear Shreeram,

You can withdraw your PF amount by using Form 10C and 19. Simply, you will have to declare that you are not working for the last two months. There is no problem as such in this kind of declaration.

First of all, you need to know your EPF as well as ESI number from your employer. If you have salary slips from any month, you can check the same on them. If your employer did not mention your EPF and ESI number on them, you can ask your accounts department or whoever is responsible for payroll.

Then, you can transfer your EPF or withdraw the same.
