Wage Ceiling Increasesd Under Payment Of Wages Act [Thread 47517]

Government of India, Ministry of Labour has revised the wage ceiling from Rs. 6500 to Rs. 10000 only under the Payment of Wages Act with effect from 8th August 2007, vide its notification no. S.O.1380(E).

The implication of this amendment would be that now employees drawing wages/salary up to Rs. 10000 can file their claims for recovery of their dues or illegal deductions from the employer. Anyone interested in a copy of the notification may ask for the same. However, it will also be published in BUSINESS MANAGER magazine too.

Dear all,

I have been contacted by many friends to clarify the impact of this amendment on other statutes. I would like to clarify that this amendment has no impact on ESI, PF, or GRATUITY. It has been a relief to employees who now draw up to 10,000/- to claim their unpaid wages or illegal deductions from employers through labor authorities in the area. Until now, only employees drawing up to 6,500 were eligible to go to the labor department against employers for payment of their earnings on time.

Dear Sarla,

Amendment in the Payment of Wages Act, thereby revising the salary ceiling from 6500 to 10000, will not have any impact on the Workmen's Compensation Act or ESI, PF, Bonus, or Gratuity.

Thank you for sharing the information. In fact, I happened to read the same, and while discussing with my colleague, Head of Finance, he pointed out that nowhere in the notification is it mentioned that it is applicable to ESI. Request you to enlighten us, please!

Also, how should we deal with the situation for the deductions made prior to the notification and deposited with ESI accounts? Here, the company is a larger contributor with 4.75% compared to the employee's share of 1.75%. Can we ask for the recovery?

Dear Rajat,

This enhancement of the wage limit under the Payment of Wages Act has nothing to do with ESI, PF, Gratuity, or Bonus.

The object of the Payment of Wages Act is to regulate the payment to employees from the employer, which means that the employer is under obligation to pay salary or earned wages latest by the 7th of each month for the preceding month with certain legally permissible deductions. Now, if the employer does not pay the salary or deducts some amount from wages/salary which is not permissible, where does the employee seek relief?

Also, which category of employees can take protection under this act against the employer for their illegal actions?

The act answers these questions.

Now, any employee who draws Rs. 10,000 or less can seek relief under this act and can approach labour authorities. Earlier, employees drawing up to Rs. 1,600 were eligible to seek relief, which was ultimately enhanced to Rs. 6,500 and now made Rs. 10,000.

ESI deductions are permissible under the act, and this amendment nowhere implies that the employer has to deduct ESI on Rs. 10,000 for each employee.
