Confused About Sudden Relieving Letter After One Year in Government Job – Need Guidance!

Request for Assistance with Relieving Letter Issue

I joined the central government organization in July 2012 and have completed one year of service. However, after three months of my 1-year service, I was suddenly issued a relieving letter in which nothing was mentioned. I joined under the PWD (Visually Handicapped) category.

I am unsure of what to do next. I have been seeking guidance from my supervisors and diligently following their feedback. I feel like I have been deceived by my supervisors.

Please assist me in resolving this issue.

I completed one year of service on July 3rd. After a three-month initial probation period, they suddenly gave me a relieving letter. As per the central government policy, if you don't receive any confirmation or extension about your probation, it is considered to be a confirmation.

Probation Confirmation for Central Government Employees

If you don't receive any information for three months after your initial probation, it is considered to be confirmation. This is applicable for central government employees.

"A probationer who is not making satisfactory progress or who shows himself to be inadequate for the service in any way should be informed of his shortcomings well before the expiry of the original probation period so that he can make special efforts at self-improvement."

If you fall under the category of workmen, you can approach Mr. Anjaneyulu at the JCL Office in Chikkadpalli, RR District. He will guide you in this regard. Otherwise, you can file a civil suit in your company's jurisdiction.

Consider Approaching CAT Bench

Or approach the CAT bench, which can take up your case. Since you were recruited under the PH category, they could have transferred you instead of relieving you.

In many cases, the government sector will act like this because they don't care about the consequences. The probationer can't claim confirmation, even in the case of employment after the probation period, from one point of view. From another perspective, the engagement of a probationer is meant to fill a permanent vacancy, which will lead to confirmation. You can ask them for relief; otherwise, approach the respective forum to seek relief.

If they terminate me before the initial probation period, probably I can't say anything. However, after my initial probation period, which was supposed to end by July 3rd, 2013, they didn't say anything at that time. But after 3 months of my probation period, they suddenly gave me this relieving letter.

I think they should have given an intimation before taking such a step. Can this be taken to a legal route? Any advice.

Threats and Discrimination at Work

Above all, my supervisors always threatened me in the name of my disability. They have threatened several times, saying, "You are under probation, we can do whatever we want. No one can question us." As it is a central government organization, are they bound to follow central government rules, right?

They never mentioned that my performance is poor in front of me. They have played a well-planned game with me. I want to sue them now as they have ruined my career at the central government organization.

You should have approached your reporting manager when your probation period was completed to know whether you became permanent or not. Everything needs to be documented for proof, and keep this in mind for the future as well.

I would suggest you talk to the concerned authorities of your organization, try to understand the situation, and then come to a conclusion before taking any step. You should make yourself aware of every fact in this context. Try to have more face-to-face interactions for better clarification. It's your right to know if there is any performance issue or any loophole from your end.

I was asked by my reporting officer well before the expiration of my probation period; they said that probation is nothing serious in our organization and to take it as a routine matter. I have crossed my probation period, and three months have passed, after which I received this relieving letter. Right now, I have replied via email indicating my concerns about the issue. I have to wait and see their reaction from their end. I never received my CR review report. In central government organization rules, a probationer should be informed about any adverse remarks, if any, well before one month of the expiration of the probation period. In my case, they did not. They simply issued the relieving letter, which is very unfair.

It is great to see that you have initiated communication from your side with your officials. Please continue pursuing this matter until you get a fair and satisfactory resolution. Request members working in Central Govt organizations to put forth your suggestions, which will also be informative for members like us.

Similar Situation in State Government

My brother is also facing a similar situation. He is working for the state government in the Revenue department. He was suspended a year ago on flimsy grounds. He has been pursuing reinstatement, but unfortunately, from the peon of his office to the highest officials, all have been demanding under-the-table money. Despite patronizing them, the matter remains unresolved. This is the rampant state of affairs in state and central government agencies. No wonder we do not get efficient services from them.

As I am working in the private sector, I cannot really contribute any views on how to handle this situation, but I genuinely hope that things work out for you.
