Navigating Workplace Fatalities: What Documents Are Needed for Family Compensation?

Please help me with the below-mentioned problem. If a fatal accident takes place at the workplace, what are the documents we need to comply with for various departments to compensate his family?

- Provident Fund
- ESI (How much amount can he get?)
- WC Policy
- GPA

Kindly suggest me on this matter, as I am a fresher in HR.

Provident Fund and Related Benefits

Provident fund will be deposited. The EDLI maximum is 1.5 lakh, depending upon the service.

ESIC Pension and Funeral Expenses

The ESIC pension is approximately 60% of the gross amount to dependents. Funeral expenses are 10,000.00 INR.

Workers' Compensation (WC)

WC is applicable if not covered under ESIC, and the amount depends upon age. There is a chart in the act for the same. For formalities, contact the local authority.

Provident Fund

1. Fill Form 10D (EPS) and Form 20 (EPF), attach the Death Certificate, Address Proof, Family Details, Nominee/Legal Heir certificate, and Bank Account proof. After obtaining the employer's signature, submit the forms to the PF Office to get the Pension and PF Amount to the family of the deceased.

2. EDLI: Fill out Form 5 (I.F) and send it to the PF Office so that the 20 months of EPS Contribution or Rs. 130,000/-, whichever is less, will be payable.

3. GPA Policy/WC Policy: The application for a claim should be filled out (which will be supplied by the Insurance company for GPA/WC Policy). Attach the death certificate, certificate from the employer, Compensation payment draft, acknowledgment given by the Workmen Compensation Commissioner, Medical Expenditure details, Family Details/Legal Heir details, Muster Roll & Wages Sheet. Forward the same to the concerned Insurance company.

EDLI and Compensation Details

The EDLI maximum limit is ₹1.3 lakh (only applicable in the event of death).

Funeral expenses are ₹2,500.

Pension will be determined by both the Provident Fund (PF) and the Employees' State Insurance (ESI).

The required documents include the FIR and the ESIC report.
