What if the PF amount is not deposited by the employer and the details of PF provided on the salary slip do not match with any records? Can the employee take legal action against the company? Please advise.

Well, it would be better if you consult with your employer or HR first and see what they say. It may have been a mistake, and if you later find that something is indeed wrong, you can then go to the city or regional office of the concerned department and file a complaint.

If it is by error, then it is okay. But what is generally seen is that they do all kinds of manipulations by not depositing PF contributions. When they intentionally do it, any complaint by any individual with any authority will face the wrath of the management.

Strategy to Address PF Manipulations

What I suggest is to work out a strategy and raise an RTI through somebody with EPF authorities to know the exact information. Any malpractice will not only get exposed but also get corrected at that stage itself.

Before lodging any complaint against your own company, you must submit a representation to your HR/Accounts Department and get a reply first. Secondly, nowadays there is a facility to view your PF details on the web. Otherwise, you can inquire with the PF Department. With all these steps, if you are sure, then you can proceed legally to seek justice.

The PF number was tracked, and it was a typo. I have a query. I left this organization on July 25th, 2013, and when I checked my PF balance online, it states EE Rs 22,217 and ER 6,806 (accounts updated up to 31-03-2013). Considering my contribution of Rs 780 and the same amount by the employer, the total should exceed this. I worked with this company from October 18th, 2010, to July 25th, 2013.

In case of any anomalies in your pay sheet and PF deductions, please contact your HR Department and the Accounts Department of your organization. If you are not receiving any response from them, you can approach the appropriate authorities after checking the concerned website.

Checking Your PF Balance

If you want to check the PF balance available in your account, please visit the EPFO website at EPFO (link updated to site home). If you are not receiving any proper SMS alerts, consult your HR Department again.

Final Steps for Unresolved Queries

Only at the final stage, please approach the EPF Office Enforcement Officers of your area regarding your query (underpaid or not paid). They will inspect all relevant documents at your office and in the PF records, and then guide you further on the next course of action.

I would suggest you first visit the EPFO website EPFO (Govt. of India) and take a printout of the e-passbook. You can verify the contribution details, and if you still have any grievances, you can either take it up with your HR department or register your grievance in EPFiGMS, which you can do online on the EPFO website.

Secondly, the major portion of the employer's contribution is diverted towards the Pension Fund. Hence, you cannot expect a full refund of the employer's contribution towards PF. The employer's contribution is paid as a pension if you are eligible or returned as a withdrawal benefit if you are not eligible for the pension.
