Waiting for Salary After Notice Period: Can I Take This to Labor Court?

Hari 17
I have worked in a company. I served a two-month notice period. During the notice period, no salary was paid. Afterward, I came to know that the two months of salary would not be paid at the time of relieving. Management said the salary and FnF (Full and Final settlement) would be paid after 45 days from the last working date. However, I have completed the 45 days, but I have still not received the salary. Please suggest if I can appeal the case through the labor court and how long it takes to resolve.

Please elaborate on your tenure in the company, the size of the company, the industry it operates in, the company's status (registered or not), and whether all the details you mentioned regarding the notice period are specified in the employment agreement. Once I have this information, I can provide you with better suggestions.

First of all, let the forum know whether you are on probation or a confirmed employee. Please also inform us about the notice period terms and/or termination clause of your company.

According to the law, every employee who works must be paid for each day worked. However, before directly approaching the labor court, it is advisable to first contact your company's HR department and inquire about the reason for not receiving payment for the 60 days of notice period you worked. If the response received does not align with the principles of justice, one should consider seeking legal recourse through the court.
